Acceptance of the Terms
Access, navigation and use of the website of MEDIFORMULA, S.A. DE C.V. ("True Medical"), available in the URL https: / / truemedical.com.mx (hereinafter the "Site"), involves the full and unreserved acceptance of these Terms and Conditions, as well as of the documents incorporated here by reference. If the User does not accept these Terms and Conditions, he must refrain from using the Site and the services offered by True Medical.
Object of the Site
The Site is operated by True Medical, who acts as an intermediary and product dealer, providing the User with access to information, catalogue, online purchase process and services related to the acquisition of various health, welfare and consumption products (hereinafter "Products").
General conditions of use
- The Site and its services are aimed at the elderly and with the legal capacity to hire, in accordance with Mexican law.
- The User undertakes to provide accurate, accurate and up-to-date information on all forms of the Site.
- The use of the Site for the conduct of illegal, misleading, fraudulent or contrary activities is prohibited.
- True Medical reserves the right to block, suspend or cancel accounts and user access that do not comply with these Terms.
Purchase Process
- Each Product shown on the Site includes description, price, specifications and estimated delivery time. All sales are understood to be subject to availability of inventory and internal confirmation of True Medical.
- The prices are expressed in Mexican pesos and include taxes unless expressly indicated otherwise.
- The images of the Products are illustrative and may differ from the final product delivered.
Payments
- The User may make the payment of the Products by means enabled on the Site (credit / debit card, bank transfer or other indicated).
- True Medical does not store or collect bank data from its Users, simply integrating certified safe paywalkways.
- The processing and validation of payments is subject to approval by the relevant financial institutions.
Delivery
The products purchased will be delivered in the address provided by the User, in accordance with the specified shipping times and policies at the time of purchase.
True Medical will not be liable for delays attributable to third parties, couriers or causes of force majeure.
The User shall verify the integrity of the package and report any anomaly within 24 hours of receipt.
Guarantees
New products on the market enjoy the guarantee offered by the manufacturer according to the terms and conditions applicable to each. True Medical respects and manages security claims in good faith.
Reconditioned or imported products could have limited guarantees, which will be clearly noted in their descriptive sheets.
Cancellations, Returns and Reimbursements
The User will be able to cancel the purchase prior to its shipment and release, communicating directly with the customer service area.
No return of delivered products shall be allowed, except for a manufacturing defect or error attributable to True Medical, in which case the User shall have 5 calendar days from the delivery to report the incident.
El producto devuelto deberá estar sin uso, en su empaque original y con todos sus accesorios, manuales y etiquetas.
No aplican devoluciones ni reembolsos en medicamentos, suplementos alimenticios, productos de cuidado personal ya abiertos, productos perecederos ni en software, licencias digitales o descargas una vez activadas o entregadas.
En caso de proceder el reembolso, éste se realizará por el mismo medio de pago en un plazo no mayor a 15 días hábiles tras validación del caso.
Limitación de Responsabilidad
True Medical no otorga garantía alguna respecto a los resultados, eficacia o idoneidad de los Productos para un propósito particular, siendo responsabilidad del Usuario consultar con su especialista previo a la adquisición y consumo.
En ningún caso True Medical será responsable por daños indirectos, consecuenciales, lucro cesante, pérdida de datos, fallas en la entrega derivadas de causas ajenas a su control o por mal uso de los Productos por parte del Usuario.
La responsabilidad total de True Medical no excederá el importe efectivamente pagado por el Usuario en la transacción controvertida.
Propiedad Intelectual
Todos los derechos de propiedad intelectual sobre los contenidos, imágenes, marcas, logotipos y bases de datos del Sitio son propiedad de True Medical o de sus legítimos titulares, quedando estrictamente prohibida su reproducción, uso o explotación no autorizada.
El uso indebido de la información y materiales será sancionado conforme a la legislación mexicana aplicable.
Protección de Datos Personales
True Medical tratará los datos personales de sus Usuarios conforme a lo señalado en el Aviso de Privacidad publicado en el propio Sitio, comprometiéndose a mantener estricta confidencialidad y medidas de protección jurídica, técnica y administrativa adecuadas al marco legal mexicano.
Modificaciones
True Medical podrá modificar estos Términos y Condiciones en cualquier momento, notificando los cambios a través del propio Sitio. El uso continuado del Sitio implica la aceptación de las modificaciones.
Legislación Aplicable y Jurisdicción
Estos Términos se rigen por la legislación aplicable en los Estados Unidos Mexicanos.
Para la interpretación, cumplimiento y ejecución de los presentes, las partes se someten a los tribunales competentes de la Ciudad de México, renunciando expresamente a cualquier otro fuero por razón de domicilio presente o futuro.
